What Article 27 actually requires

EU AI Act Article 27 requires deployers of high-risk AI systems under Annex III to conduct a Fundamental Rights Impact Assessment before deployment. The regulation specifies what the FRIA must cover — but not how to conduct it. Existing guidance (DIHR/ECNL, ALIGNER, Bertaina et al.) produces questionnaire-based outputs: documentation that says what was considered, but not how severely, how likely, or how cumulatively. These outputs may satisfy a checkbox audit — but not a regulatory investigation or a legal challenge.

The Valorial FRIA methodology

Applied to Article 27, this yields a FRIA with analytical depth: not “we considered this right” but “this right faces a high-severity, medium-likelihood impact, partially mitigated by existing controls, with residual risk requiring the following measures.”
